Terms of use
1. Provider and scope
These terms govern the use of Bauarchiv provided by
Kurt Neuenschwander
Krauchthalstrasse 126
3414 Oberburg.
Contact:
Bauarchiv allows properties, floors, units and rooms to be documented with text and media. A property is displayed publicly only after it has been reviewed and approved by an administrator.
2. Accounts and content
Creating and editing a property requires an account with a verified email address. Login credentials must be kept confidential. Users are responsible for the information and files they submit.
Only content for which the necessary storage and publication rights are held may be uploaded. The rights of people depicted or named must be respected, especially for identifiable people, private interiors, plans and personal information. Confidential documents, copies of identity documents and other particularly sensitive information must not be uploaded.
The operator may block or remove unlawful or misleading content, or content that infringes third-party rights, and may refuse publication. There is no entitlement to public approval.
3. Public display and usage rights
After approval, property details and approved media may be publicly visible online. By submitting content, the user grants Bauarchiv the rights needed to store, technically process and display it as part of the service. The underlying rights remain with their respective holders.
Approval does not guarantee that information is complete, current or legally checked. Anyone who finds problematic content can report it to the operator.
4. Price and payment
Creating a property is free while the paid feature is inactive. When the one-time payment is enabled, creating a new property costs CHF 10.00 in total. The operator is not subject to VAT; no VAT is charged. This is not a subscription. Existing properties are not charged retroactively. Administrator accounts are exempt from this fee.
Bauarchiv displays the service and total price before redirecting to Stripe Checkout. Clicking “Go to Stripe Checkout” or “Continue to Stripe Checkout” does not place a paid order. In checkout, payment details can be reviewed or the process cancelled before final confirmation. The paid order is placed only when it is confirmed with Stripe. After successful payment, a credit for exactly one property is activated, and an email is sent stating the service, total price and payment reference.
The fee covers the ability to create and document a property, not public approval. An unused credit remains available for creating a property and does not expire after 14 days.
Within 14 days of payment, a refund of an unused credit may be requested by email. After checking the payment and credit, the amount will be refunded to the original payment method. Refunds are not processed automatically through the website.
Once a property has been created, this voluntary refund is no longer available. If a property is rejected during review, it can be corrected and resubmitted; rejection does not trigger an automatic refund. Later deletion does not automatically result in a refund either. Failed or duplicate payments and paid credits that cannot be used for technical reasons are reviewed regardless of the voluntary period. Mandatory statutory rights remain unaffected.
5. Availability and changes
Bauarchiv strives to operate reliably. Maintenance, technical faults and necessary security measures may temporarily limit availability. Material changes to these terms will be announced appropriately before taking effect. Payments already completed remain subject to the terms displayed at the time of purchase.
6. Privacy and requests
How personal data is processed is described in the Privacy policy. Requests concerning your own data or the removal of content can be sent to the contact address above.
